The following terms and conditions were updated on 25/08/2016. The use of our website (www.fieldandflower.co.uk) and purchase of goods from field&flower Ltd through the website is as a condition of your agreement with our following terms and conditions. Please note the use of “we” or “our” means field&flower ltd, “you” or “your” means the individual using, accessing or purchasing from our website.
- Prices, descriptions and availability of goods
Whilst we regularly review our pricing, all prices are subject to change without prior notice. We do not accept liability for any inaccuracies, omissions or errors in our product descriptions, including pictures, information, prices and references. Many of our suppliers are independent, small-scale farmer/producers, therefore all products are subject to availability. When goods and products are temporarily out of stock we will either substitute the item and notify you on your order note or contact you to arrange one of the following: a refund, a suitable replacement or to have the goods/products delivered to you at a later date. Any order requests are accepted at our sole discretion whilst we also maintain the right to decline orders without explanation.
- Sales tax
Value Added Tax (VAT) is not applicable to meat and poultry products; the VAT is calculated on shipping destination. When applicable it is included in the price for orders shipped to destinations within the European Union (EU).
We use both our own drivers and on out of house courier service to deliver our boxes. All orders are shipped on a next day delivery (arriving between 07:00 and 18:00hrs) on our stated dispatch/delivery dates. All goods and products are securely packaged in fully recyclable EPS cool boxes packed with ice which will stay cool for up to 36 hours. In the vast majority of cases your order will arrive from our butchery to your stated address within 24 hours, we will inform you if for any reason your goods are delayed. If they are delayed beyond the stated 36 hours or do not reach you at all we will arrange a full refund or replacement goods.
If you are not home to receive your box, our couriers will leave the goods in your designated place that has been stated by you on your account. Once someone has taken receipt of the order or the courier has left your order in your stated designation we do not accept liability for loss or further delay of the goods. If for whatever reason you don't receive your box please inform us within 24 hours so we can either contact our drivers or track it and if needs be, arrange for any replacement goods to be sent to you instead.
Delivery charges are £3.95 for all customers (unless individually told otherwise). There is one exception on Christmas Eve when an increased rate will apply - this will be stated closer to the time on the website at checkout.
- Regular Customers
These are customers that have bought our products through the ‘regular boxes’ section of our website, with the intention of receiving an order from us every month on a 4-week cycle. This cycle however can be changed. A reminder email is sent 48 hours prior to the deadline of changing your next delivery date should you wish to do so. You’re also able to alter the frequency of your regular deliveries, to do this contact us via email or telephone through the ‘contact us’ link on the website. In addition to this you may also alter the content of your next regular box at any time from receipt of your previous order until 14 days prior (3 days if you’re on our Weekly Box scheme) to the stated delivery date of that next coming order. Upon first registration to a regular box you agree for us to take payment the day after the order deadline.) A reoccurring transaction mandate is used to avoid the hassle of setting up payment each time. At no point are you tied to a subscription or fixed term and may cancel your next box at any time before the deadline. Once payment has been taken i.e. after the order deadline, we cannot cancel or refund payment and any cancellation of the service will then apply to the following order. You agree to a flat rate reoccurring payment (please note we do not use a direct debit system) - the amount depending on the size of the regular box. If you wish to add extra items to your regular box over and beyond your credit allowance you will be charged according to the increased difference. To cancel your regular box or skip an order please contact us via email or telephone via the contact us link on our website. Payment for one-off orders i.e. those made through the ‘farm shop’ or ‘one-off boxes’ section of the website will be taken at the point of order. These orders are subject to a flat rate delivery charge separate to that of the cost of the items you are purchasing, you will be clearly informed of the cost of delivery before payment is required. For regular customers, as stated in section 3 of these terms and conditions, delivery charges are £3.95
- Cancellations and Refunds & Complaints
As we are a small business selling perishable goods we regret that we cannot cancel an order once payment has been taken. If for any reason you are not happy with your goods please contact us and we will do our very best to resolve the situation whether it be by way of credit or replacement goods, this is entirely at our discretion. For regular customers please see section 4 for cancellations and refunds. If you wish to make a complaint please email or call us via the ‘contact us’ link on our website, we will do our very best to respond as quickly as possible and try to resolve it. Your custom is very important to us and we are continually seeking to improve our service to you.
- Copyrights and Trademarks
Third party copyright, trademarks, brand and product names, and titles on our website are recognised. This website is protected by Copyright and the Copyright, Trademarks, Logos and Intellectual Property rights for the content of field&flower Ltd. ALL RIGHTS RESERVED. Use, printing or copying of materials on this website, other than in the course of browsing, choosing products and placing order with us, is prohibited. Framing this website is also prohibited.
The security of your financial information is extremely important to us. Online payment is dealt with by Streamline (Natwest) and using SagePay as the payment gateway, both industry leaders in online payment solutions. Our website uses SSL (Secure Socket Layer) in order to encrypt sensitive information during the payment process.
- Information Collection and Sharing
We ask for certain details in our registration and payment processes such as your name, address and contact information. After the necessary information is used for the payment and delivery of your goods we keep your records to make future transactions quicker and smoother for you. For regular customers please see section 4 with regard to your financial information. We adhere to the rules and guidelines as set out by the Data Protection Act 1998. We will not share or sell this information to third parties other than as disclosed in this statement. We hold no responsibility and accept no liability for the content and actions of any and all websites linked to our website that are not owned and maintained by ourselves.
- Log Files
We use IP addresses to analyse trends, administer the website, track user's movement, and gather broad demographic information. IP addresses are not linked to personally identifiable information.
- Limitations of Liability
All information provided on our website is free of charge and therefore you acknowledge that it would be unreasonable to hold us liable in respect of the website and the information contained on it. Our liability is limited and excluded to the maximum extent permitted under applicable law. We will not be liable for any direct or indirect loss or damage arising under these terms and conditions or in connection with our website, whether arising in tort, contract, or otherwise. Without limiting the generality of the foregoing exclusion, we will not be liable for any loss of profit, contracts, business, goodwill, data, income, revenue or anticipated savings arising under terms and conditions or in connection with our website, whether direct or indirect, and whether arising in tort, contract, or otherwise.
- Law and Jurisdiction
These terms and conditions will be governed by and construed in accordance with English law, any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England.
